Upcoming hands-free legislation will affect some 23 million drivers in California. Yet, there’s still a lot of confusion and questions flying around.
Drivers have to use a hands-free device such as a headset or speakerphone when using their cell phone while on the road. Teenage drivers under 18 years of age can't use their cell phone at all while on the road.
The new law goes into effect on July 1, 2008. There will be no grace period and no fix-it tickets issued.
Since not abiding by the hands-free law is a primary offense, drivers can be stopped and fined just for holding a cell phone to their ear while on the road.
Drivers will be ticketed $20 for the first offense (up to $70 after penalties are added); subsequent violations will be $50 (up to $175 after penalties are added).
